Should I model with 3DS Max 09?

I never had any problems using bluestreak that weren't my own fault somehow. Now that it exports regions, blitzkrieg or max8- isn't ever needed
What version you choose will also effect your file sharing ability. See this here poll about which versions others are using.

It comes with the HEK

C:\Program Files\Microsoft Games\Halo Custom Edition\blitzkrieg\MAX5 and read the readme file

The one that comes with HEK only supports Max 6-7
The one on Halomaps also supports Max 8

Max 9 with Blitzkried fails. I deleted it from the folder because it crashes my Max 9 on startup.
