I was reading about civil rights and stuff for my government class, and I came to a realization:
'To Catch a Predator' from Dateline NBC is unconstitutional.
The Fifth Amendment (self incrimination) prohibits coerced crimes. Baiting pedos with pseudo-minor chat accounts is against the constitution.

Entrapment has been a carefully walked line for a long time now. Dunno how you can arrest someone for possibly, maybe, in some alternate future where this cop was a girl, committing a crime. Same thing with drugs. Cop says "Hey want weed." -"Yeah." Arrested. Total bullshit.

Well uh, if you fall for a trap, I'd say it's a pretty clear indication that you're going to commit the associated crime at some point provided the trap was set up in a feasible manner...

This reminds me of the scenario I was in the day or two previous where I was being tailgated by a police car. We were both going 35 and the speed limit was 40, so at the end he gives up and speeds away (to 45). If I had went 45, I would have probably been given a speeding ticket. So, in this respect, I'm paying for the officer's lack in quota, which is not fair.
I'm not a big fan of entrapment. If you think they are criminal, and to that extent, just watch them commit the crime.

i have a very very jaded mindset about the australian police force and any sort of authoritative figures in general for those very same reasons.

I've heard of them letting a mate's cousin off after he took an exit ramp at something like 150-170, he told them he'd just got the car and wanted to try it out (which was true) and they said they did the same so they'd let him go, just not to do it again. Depends on the cop, really.

The question being: can you really arrest someone for something you think they would have done if you hadn't stopped them?
Well, I suppose if you actually catch them in the act, or have evidence that they were planning to commit the crime, then yeah.
But then to lure someone into doing something they might not have otherwise done... yeah, it's a shaky line.

That's dumb, reminds me of the time when a cop was going 50 in a 40... Aren't cops supposed to set a good example to others? :downs:

You're not guilty of a crime you have not committed. I think it's fair to indict and convict people of attempted crimes provided they come with significantly lower penalties, though.
