Ok, I went and did the benchmark test, to see it for myself, and I got a 33.92 fps average
According to many benchmarks I've read for my video card, when running at a higher resolution, and a higher quality, there was better fps

My Specs:
ATI HD4870 1gb vram non overclocked
2GB DDR 2 Ram (not sure if its 667, or 800)
Biostar TA780G M2+ motherboard
AMD ATHLON 64 X2 6000+ 3.1 ghz (Rated at 9.0ghz according to Sys requirements lab)
I am running crysis at 1028x768 32 Bit colour no anti aliasing, all settings at high, running in DX9 on windows XP
am I getting lower fps than I should?
Or is my ram slowing it down?
Any suggestions?

Your RAM is very likely to contribute to the slowing down, as with my specs (go check em), I can run Crysis and Crysis Warhead at 1680x1050 on Very High at an average of 25FPS.

RAM is fine.

Thing is though, your card is nvidia, and crysis is built mostly for nivdia, but I doubt that huge of a difference would be made just because of the brand, especially when mine has higher specs.

Maybe the motherboard is just very bad with bringing all the components together to make the system run solidly. I have better FPS in Crysis than Warhead. I dunno, maybe Warhead is more optimized for your card? Does this occur in other graphics intensive games?

No, i can run COD4, GOWPC and COD5 at 1600x1200 with 60+fps each

That sounds about right for your setup.

Is the reason the fps is so low because of my ram, or because its an ati card?
I also noticed, with warhead, at 1600x1200 w/o AA, at veryhigh, i get 20+fps
And, with most games, i hardly lose fps at higher resolutions, why is that?

Are you playing Crysis at super duper ultra high settings?

Its high, not veryhigh, for normal crysis, not warhead, warhead is veryhigh

Slow CPU

My cpu is slow??
BTW I ran the benchmark test, again, but in vista, running in DX10, and i got higher fps, Why is that?

but in vista
What were you using before?

Pyong Kawaguchi

Windows XP Service pack 2
BTW alongside that, a friend of mine who has both 32bit and 64bit windows vista, says that he gets about double the framerates when running in 64bit, is that true, or a lie, or because it is able to make better use of the proscessor because his is 64bit?
And, if it is because of my cpu, would a physics card help?

It runs better on 64bit vista, yes, but not twice as fast lol

Would you suggest getting 64bit vista?
Or waiting until W7 arrives?

Wait for W7 if you want
