Today I received a second legal notice from Hansen Beverages due to a skin that was infringing their copyright (a skin using the Monster energy drink label). I'm creating this thread to forewarn all content creators of Hansen Beverages' persistent and aggressive measures to protect its trademarks and strongly advise against creating any content with any association or reference to this company or any of its products!

Here is the PDF (http://www.fpsbanana.com/threads/160251) for your reference. This is bullshit, they cant do that.

Thats retarded.

He isn't making money from their product.

Just use this.

Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.

"Hey guys, some kid with an SDK is making a map using images of our products, meaning he's giving us free publicity which would otherwise cost us thousands if not millions of dollars to get anywhere else."

"That FUCKER! He can't give us free adverts! I don't want to make money, I want to lose it, especially with this recession just starting to turn! I have a family to not feed here!"

Wow, you guys need to learn about copyright and trademark laws..

They have to protect their logos, if they see it any where that isnt authorized they have to get it removed, otherwise it will break their trademark rules and the trademark will be lost.

That's not how failure-to-enforce works... ex: 'linux' is a trademark owned by the Linux Mark Institute (http://www.linuxmark.org/), but they don't go around "enforcing" the mark to keep it. It doesn't work that way.

e: The other thing to note is "good-faith" usage.

But its like if a kid drew a picture of him drinking a Dr. Pepper and posted it all over town.

The kid isn't making any money off of it, so DP cant sue him.

It's fair use. He isn't making a profit from it and he isn't claiming it as his own.
