I do believe a judge ruled drawn pornography depicting minors was within freedom of expression, and declared it legal. Also; "tasteful" and "artsy" nudity is always legal, no matter the age.

The law is very very vague. In some situations they allow it and others they don't.

In Elfen Lied's case, most likely since its brief and minimally explicit, (trust me, it is) its allowed.

...buuuuut, in cases that involve explicit sex, regardless of use, is not allowed. I'll use an example. There was an Eroge released by JAST USA recently called Kazoku Keikaku. One of the heroines in this eroge was underage at one point, but turns 18 later. Before turning 18, there where a few images of this character in the game that contained nudity. Although there wasn't even actual sex taking place in these images, they contained nudity, and therefore had to be censored when localized. I find this really strange though, since Elfen Lied contained both underage nudity and sex and was not censored. That and the fact that at the time the underage images take place in Kazoku, nothing sexual is happening. The main character just accidentally gets a glimpse at the character nude. It was either the fact that the character's genitals were visible in those images or the fact that sex with that same character takes place later in that game that made those images required to be censored. ... God I had to awkwardly word that sentence.

There are also other ways the laws are circumvented though...

For example, JAST USA is going to be bringing over a lot of Nitro+ games. A lot of Nitro+'s games contain lolis... buuuuut since the lolis in their games are either 1: not underage, or 2: not human, JAST is going to have no problem bringing their games to the states and wherever else.

Oh, I also forgot to mention the fact that Kazoku is sure as hell NOT a porn game. Its actually one of the most beloved eroge ever because of its emotional story.

As you can tell, the loli law doesn't make any sense, is stupid, vague, and pointless...

HOLY HELL!

It was awesome... but... but... I'm not sure they're doing a better job fixing the whole confusing part.

If you're an Evangelion fan, go watch now, and you'll see what I mean. They've like... Jumbled things up. Lol. Awesome still. Epic cliffhanger.
